JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-01-2016 Heard learned counsels for the petitioner and the State. The petitioner being PDS Dealer is apprehending arrest in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.
The prosecution case is that on inquiry it was found that the petitioner used to supply less quantity of grains to the consumers and used to sell them in black market. It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled. The petitioner is a lady. A statement has been made in paragraph no. 3 that the petitioner has got no criminal antecedent.
The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Patna High Court Cr.Misc. No.333 of 2016 (2) dt.07-01-2016 Let the learned court below consider the prayer for regular bail of the petitioner if she surrenders within a period of six weeks in connection with Beldour P.S. Case No. 236 of 2015 pending in the Court of Judicial Magistrate, 1st Class, Khagaria. Accordingly, the application is disposed of.
