ANJANA PRAKASH ORAL JUDGMENT Date: 29-09-2015 The Petitioner seeks quashing of the order of nondischarge dated 12.3.2013 passed by the Additional Sessions Judge Xth, Patna in connection with Sessions Trial No.530 of 2011 arising out of Phulwarisharif P.S. case No.367 of 2008. Considering that the Petitioner seeks discharge on questions of fact which cannot be gone into at the stage of 482 Cr.P.C, I am not inclined to interfere in the matter. The application is dismissed with a direction to the Court below to conclude the trial expeditiously without granting unnecessary adjournments to any party, for which reason he shall send a list of the witnesses fixing specific dates for each witnesses
Patna High Court Cr.Misc. No.16259 of 2013 dt.29-09-2015 2/2 for their examination along with a copy of this order to the Senior S.P., Patna, who is directed to ensure the attendance of the witnesses on the date fixed by the Trial Court so that there is no further delay in the trial.
