JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 22-08-2024 Heard the learned counsel for the petitioner and learned APP for the State, assisted by the learned counsel for the the informant.

2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 341, 323, 498(A) 504 and 506/34 of the Indian Penal Code, registered in connection with Saharsa Mahila P.S.Case No. 29 of 2023.

3. At the very outset, the learned counsel for the petitioner submits that the matter was compromised in the court of Principal Judge, Family Court and it was one of the conditions that, after compromise, the informant shall withdraw the case, but she did not do so.

On the other hand, the learned counsel for the informant submits that in the same order it was observed that the petitioner shall pay as interim maintenance to the informant

Patna High Court CR. MISC. No.58847 of 2024(2) dt.22-08-2024 2/2 at the rate of Rs. 6000/- per month, but the petitioner is not complying with that order regularly, to which the learned counsel for the petitioner assures that the entire arrears of maintenance amount shall be paid in two equal monthly installment after his release.

Considering the above facts and circumstances, let the petitioner, above-named, be released on provisional bail for two months on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Saharsa in connection with Saharsa Mahila P.S.Case No. 29 of 2023, and after payment of arrears amount within two months, the bail bond of the petitioner shall be confirmed by the learned court below itself.
