The petitioner seeks bail in Kotwali (Barari) P.S. case No. 389 of 2016 under Section 457, 380, 411 of the Indian Penal Code.
The petitioner is not named in the FIR. The informant lodged the case against unknown for theft of his two mobiles. The informant gave details of mobiles. During the course of investigation, one Lenovo mobile, IMEI No.
869440026222164, was recovered from the house of petitioner after tracking the same.
It is submitted that petitioner is in jail since 26.12.2016 and the mobile was recovered from joint house. The
Patna High Court Cr.Misc. No.12628 of 2017 (3) dt.26-04-2017 2/2 petitioner has got no criminal antecedent.
Considering the facts aforesaid and the fact that petitioner has got no criminal antecedent and for theft of mobile the petitioner has already remained in jail for four months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in Kotwali (Barari) P.S. Case No. 389 of 2016.
