The petitioner seeks bail in a case registered for the offences punishable under Sections 401, 414, 379/ 34 of the Indian Penal Code and Sections 25(1-B)a, 26 and 35 of the Arms Act.

The learned counsel for the petitioner submits that the petitioner is in custody since 02.04.2021, he is a person with clean antecedent and charge-sheet has been submitted in the case.

Allegation is of recovery of a mobile from the petitioner along with two motorcycles from the place of occurrence and as far as recovery of arms is concerned, the same is from other accused persons.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent, charge-sheet has been submitted in the case and there was no recovery of any arms from his posssession, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Khaira P. S. Case No.102 of 2021.

The application stands allowed.
