JUSTICE BIRENDRA KUMAR ORAL ORDER 11-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 272/273/120B of the Indian Penal Code and Sections 30(a)/32(2)/38/45 of the Bihar Prohibition and Excise Act, 2016.

Huge quantity of liquor was recovered from the vehicle to which petitioner was owner.

Petitioner has stated on oath that he has got no criminal antecedent.

Considering the facts and circumstances, let petitioner, above named, be enlarged on bail on completion of six months of custody on furnishing bail bond of Rs.10,000/-(Ten

No.17290 of 2017 (2) dt.11-04-2017 2/2 Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya/Successor Court, in connection with Chandauti P.S. Case No.319 of 2016, with condition that petitioner shall file undertaking at the time of furnishing of the bail-bond before the Court-below that he would not indulge himself in such activity otherwise the Court below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
