The petitioner seeks bail in Dhanaha P.S. Case No. 03/2017, registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(A) of Bihar Prohibition and Excise Act, 2016.

The police intercepted the vehicle of the petitioner and recovered about 211 litres of different brands of Indian made foreign liquor.

Learned counsel for the petitioner submits that the petitioner is driver of the vehicle and he had no knowledge about the articles kept in the carton loaded on the vehicle by Harindra Sahni. Harindra Sahni has already been enlarged on anticipatory

Patna High Court Cr.Misc. No.12464 of 2017 (2) dt.22-03-2017 2/2 bail. The petitioner is in jail since 09.01.2017. He has already remained in jail for two and half months and he has got no criminal antecedent.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bagaha, West Champaran in connection with Dhanaha P.S. Case No. 03/2017.
