Petitioner apprehends his arrest in connection with Laheria Sarai P.S. Case No. 12 of 2018 registered for the offences punishable under Sections 384, 385, 341, 323, 504 and 506 of the Indian Penal Code and Sections 389, 390, 392 of Bihar Kara Act, 2012.

Allegation against the petitioner is that while he was in custody there is allegation of demanding extortion from jail against him.

Submission of learned counsel for the petitioner is that as he was in custody no offence is made out against him. Further submission is that petitioner is a student.

Heard learned APP, who has opposed the prayer for

Patna High Court Cr.Misc. No.20687 of 2018 (2) dt.26-04-2018 2/2 anticipatory bail of the petitioner on the ground that allegation is serious coupled with the fact that he is accused in two other cases. Having heard both sides and in the facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner, rather petitioner to surrender and make prayer for regular bail, which shall be considered on the basis of materials available on record, without being prejudiced by this order.
