JUSTICE PURNENDU SINGH ORAL ORDER 27-06-2023 Heard Mr. Ashok Kumar Singh, learned counsel appearing on behalf of the petitioner, Mr. Mr. Prabhakar Jha and Mr. Shankar Kumar Thakur, learned counsels appearing on behalf of the State and Mr. Dr. Anand Kumar, learned counsel appearing on behalf of the respondents.

2. The petitioner has retired on 01.11.2017 and has filed the present writ petition being aggrieved by non-payment of A.C.P and M.A.C.P benefit of 7th pay revision, difference of pension, gratuity and dues amount of earned leave.

3. Learned counsel appearing on behalf of the

Patna High Court CWJC No.14627 of 2022(4) dt.27-06-2023 2/3 University inform this Court that full amount of gratuity has been paid to the petitioner in two installments and total amount of Rs. 7,50,000/- and Rs. 4,62,750/- has been credited into the account of the petitioner. The University has also paid earned leave in two installments total amount to Rs. 6,34,780/- and Rs. 1,20,029/- and same has also been credited into the account of the petitioner. The petitioner is being paid monthly pension w.e.f. 01.11.2017 with admissible D.A. and every month Rs. 9960/- is being paid in the account of the petitioner and thereafter w.e.f. April, 2019 the petitioner was paid arrears of difference of pension for the period from April, 2019 to November, 2019 and Rs. 2,35,547/- has been paid as difference of pension from 01.11.2017 to 31.03.

2019 total due amount on the basis of A.C.P. and M.A.C.P. of Rs. 14,29,547/- calculated. Out of which Rs. 10,90,646/- earlier by the College for the period April, 1997 to February, 2016 and from April, 2017 to October, 2017. Rest amount of Rs. 4,08,461/- was paid on 27.05.2023 and in support of the said statement a letter dated 16.06.2023 issued by the Principal of H.D. Jain College, Arra has been placed on record.

4. In these background Dr. Anand Kumar, learned counsel appearing on behalf of the University submit that all the

Patna High Court CWJC No.14627 of 2022(4) dt.27-06-2023 3/3 admissible dues along with due interest has been credited into the account of the petitioner and the grievance of the petitioner has been redressed.

5. Having regard to the facts of the case as well as information given by Mr. Dr. Anand Kumar, upon instruction received from the Registrar of the University, it appears that all the grievance of the petitioner has been redressed.

6. However, if petitioner is so advised, he may file a detailed representation.

7. In case he is still aggrieved of any of the dues which has not been paid to him, the Registrar of the University must ensure to make payment of admissible dues after verifying from the record and also make payment of interest till the date of payment of such dues amount on account of retiral benefit, if any, within a period of six weeks.
