JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 504, 379 and 354 of the Indian Penal Code and Section 3 of the SC/ST (Prevention of Atrocities) Act.

The prosecution case is that the accused person came at the door of the informant and started abusing the husband of the informant when the informant came to protest then she was being assaulted and her gold chain was snatched and when her husband came to rescue then he was also assaulted and abused by calling caste name.

It is submitted by learned counsel for the petitioner that for the occurrence of 26.07.2015, the FIR was registered on 07.08.2015 when no injury was caused to anyone. The accusation

Patna High Court Cr.Misc. No.56927 of 2015 (2) dt.17-12-2015 2/2 is omnibus and general. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the delayed lodging of the case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Katihar in connection with Manihari P.S. Case No. 96 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
