2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 420, 409 of the Indian Penal Code.
3. It is alleged that this petitioner, while working as Branch Post Master at Fatehpur, defalcated an amount of Rs. 14,85,100/- (fourteen lacs eighty five thousand one hundred).
4. It is submitted that due to lack of knowledge of using the computer, petitioner did not properly run the computer device. It is further submitted that petitioner has already deposited the alleged amount in the Government Treasury for which and Post Master Bahadurganj issued a certificate on 20.01.2023 (Annexure '2'). Petitioner is a 66 years old man suffering from various ailment and has got clean antecedent.

Considering the fact that petitioner claims clean antecedent and he has already deposited the alleged amount, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Kishanganj in connection with Fatehpur P. S. Case No. 14 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
