JUSTICE ASHUTOSH KUMAR ORAL ORDER 26-04-2018 The petitioner, who is the friend of the victim girl, seeks bail in anticipation of her arrest in connection with Riga P.S. Case No. 254 of 2017, dated 02.09.2017, instituted for the offences punishable under Sections 363 and 366(A)/34 of the Indian Penal Code.

The daughter of the informant went missing. On further enquiry by the informant, he came to learn that one Vikash Kumar has enticed her daughter away for the purposes of marrying her. In the aforesaid act of taking away the daughter of the informant, the petitioner has also helped in someway or the other. The other family members

Patna High Court Cr.Misc. No.21436 of 2018 (2) dt.26-04-2018 2/2 of Vikash Kumar are also said to have assisted aforesaid Vikash Kumar in taking away the daughter of the informant. Learned counsel for the petitioner has submitted that the petitioner, who herself is a young student, is only a friend of the daughter of the informant and has unnecessarily been made accused in this case. There is no material whatsoever to come to the conclusion that the petitioner had helped the aforesaid Vikash Kumar in taking away the daughter of the informant away.

Regard being had to the aforesaid facts, the petitioner above named, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, be released on anticipatory bail on her furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Sitamarhi in connection with Riga P.S.
