The petitioner seeks bail in connection with Sakra P.S. Case No.218 of 2016 registered under Sections 302 and 201/34 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that there is no eye witness to the occurrence. In fact, the petitioner is the step son of the deceased Bhuli Devi, the aunt of the informant, and the deceased died natural death due to illness and her last rites was performed but, with an ulterior motive, the informant, has lodged this false case. Patna High Court Cr.Misc. No.4804 of 2017 (3) dt.24-03-2017 2/2 criminal antecedent is in custody since 20.09.2016 and, on investigation, the chargesheet has already been submitted against the petitioner.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-cum- Sub Judge-XIII, Muzaffarpur, in connection with Sakra P.S.
