JUSTICE BIRENDRA KUMAR ORAL ORDER 12-04-2017 Heard the learned counsel for the petitioner, the informant and the State.

This is a petition for grant of regular bail for offences under Sections 363 and 363A/34 of the Indian Penal Code.

The first information report was lodged with allegation of kidnapping of Mosarrat Khatoon. The victim-girl in her statement under Section 164 of the Criminal Procedure Code alleged rape and marriage allegedly committed by co-accused, Md. Takmil. Submission of the petitioner is that the matter is of love affairs and under pressure of the parents whatever, the victim has stated under Section 164 of the Criminal Procedure Code is against co-accused.

No.17362 of 2017 (2) dt.12-04-2017 2/2 Considering the aforesaid fact, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Rosera P.S. Case No. 176 of 2016 to the satisfaction of the Additional Chief Judicial Magistrate, Rosera, Samastipur, or successor Court.
