JUSTICE SANJAY PRIYA ORAL ORDER 22-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Fulwaria P.S. Case No. 91 of 2016 instituted for the offence under Section 395 of the Indian Penal Code.

It has been submitted that petitioner is not named in the written report. His name has been disclosed by co-accused Nago Mahto @ Nago Kumar in his confessional statement. The other co-accused with similar allegation have been granted bail by a coordinate Bench of this Court vide order dated 28.01.2017, 09.01.2017 and 09.02.2017 passed in Cr. Misc. Nos. 55710 of 2016, 55177 of 2016 and 49286 of 2017. From the written report, it appears that on the alleged date of occurrence, some miscreants armed with fire-arms took away the cash of Rs. 1,50,000/- and mobile phone of the

Patna High Court Cr.Misc. No.12954 of 2017 (2) dt.22-03-2017 2/2 informant.

FIR has been registered against unknown.

It is mentioned in the impugned order that the name of this petitioner has come in para 34 of the case diary in the confessional statement of co-accused Nago Mahto @ Nago Kumar.

Considering the aforesaid facts and circumstances, the prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sri Raghubir Prasad, learned Judicial Magistrate 1st Class, Begusarai, in connection with Fulwaria P.S. Case No. 91 of 2016 , subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) Ravi/- U T
