1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 337, 147, 149, 341, 342, 323, 324, 325, 353, 332, 338, 333, 307, 224, 225, 427, 120B, 504 and 506 of the Indian Penal Code.
3. Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that he received an information while patrolling that some home guard jawans of Excise Police are being assaulted by antisocial elements, accordingly, he reached the place of occurrence, where 50-60 people started abusing and attacked the
Patna High Court CR. MISC. No.59479 of 2024(2) dt.30-01-2025 2/2 vehicle of the informant and even tried to tear the uniform of other police personnel and government vehicle was also damaged.
4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case. It is next submitted that from perusal of allegation as alleged in the FIR, it would manifest that the allegation against the petitioners is general and omnibus in nature.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Kursakant (Kuari) P.S. Case No. 232 of 2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
