2. The petitioner seeks bail in connection with Baniyapur P.S. Case No. 60 of 2023 registered for the offence punishable under Sections 392 of the Indian Penal Code.

3. This is the second attempt for bail of the petitioner as earlier such prayer was rejected by order dated 10.01.2024 in Cr. Misc. No. 75376 of 2023.

4. The petitioner is accused of looting a motorcycle, Rs. 59,020/- and a Tab.

5. Learned counsel for the petitioner very fairly submits that the trial has started and one witness has been examined.

6. In view of the fact that the trail has started, this

7. The Superintendent of Police, Saran is directed to ensure the presence of the witnesses on the date fixed in the trial so that the trial is not delayed and the accused do not get the benefit of the delay.

8. Mr. Jharkhandi Upadhyay, learned APP for the State is directed to communicate a copy of this order to the Superintendent of Police, Saran and take necessary instructions from him with regard to the aforesaid case.

9. Let a copy of this order be communicated to the Superintendent of Police, Saran for its compliance through FAX or e-mail forthwith.
