JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 25-11-2022 Heard learned counsel for the petitioners and learned APP for the State through virtual court proceedings. The petitioners apprehend their arrest in connection with Jagdishpur P.S. Case No.244 of 2022, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3 litres of country made Mahua Paas and other articles used in manufacturing of illicit liquor have been recovered from the place of occurrence. The petitioners and other co-accused persons are said to have fled away from the place of occurrence after seeing the police.

Learned counsel for the petitioners submits that the

It is submitted that the petitioners have got no criminal antecedent as stated in paragraph-3 of the bail applications. The local Chowkidar has disclosed the name of the petitioners. It is further submitted that there is no recovery from the conscious possession of the petitioners.

The learned APP for the State opposed the prayer for anticipatory bail of the petitioners and submitted that the petitioners are involved in manufacturing of illicit liquor. Considering the fact that the petitioners are members of the syndicate involved in manufacturing of illicit liquor, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioners is rejected.
