1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Gaurichak Police Station Case No. 754 of 2022, disclosing offences under Sections 341, 323, 324, 307, 379, 354, 504, 506 of the Indian Penal Code.
3. As per the First Informant Report, the petitioner has allegedly assaulted the informant by means of iron rod on his head due to which, informant sustained head injury.
4. Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in the present case due to village politics. The dispute had initially taken place due to having eggs of the villager of the informant, Mantu Yadav and
Patna High Court CR. MISC. No.62628 of 2023(2) dt.17-10-2023 2/3 Pintu Yadav who assaulted the son of the informant. Learned counsel further submits that no apparent injury has been found on the head of the informant which would be evident from the injury report of the Patna Medical College and Hospital at Annexure-3. He further submits that from perusal of the impugned order, it would be evident that the nature of the injury is simple.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that the injury caused to the informant has been found simple in nature and both the parties are co-villagers and the dispute has taken place on a trivial issue of having eggs, accordingly, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, Indrajeet Yadav @ Phujji Yadav @ Indrajeet Kumar @ Phujji Kumar Yadav, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Patna City, in connection with Gaurichak Police Station Case No. 754 of 2022, subject to the condition laid down under
