The petitioners are languishing in custody since 24.01.2014 in a case registered for the offences punishable under Sections 25(1-B)a, 26/35 of the Arms Act and 17 of Criminal Law Amendment Act.
From the possession of petitioner no. 1 one loaded country made pistol, one cartridge, Rs.23,000/-, two mobiles, six election identity card and from the possession of petitioner no. 2 country made pistol, three cartridges, Rs.60,000/-, one mobile and naxal literatures were recovered.
Patna High Court Cr.Misc. No.24632 of 2014 (04) dt.08-01-2015 2/2 It is submitted by learned counsel for the petitioners that the petitioners have been roped in 5-6 cases by the police without any proper evidence and except one case petitioners are on bail in other cases.
Considering the period under custody and the nature of recovery, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Parsa P.S. Case No. 04 of 2014. The petitioners shall appear before Parsa Police Station once in every fort-night and make their attendance. The learned court below will positively cancel the bail bonds of the petitioners, if they substantially get involved in some serious nature of the offence or default for two consecutive occasions.
