The petitioner is accused in connection with Tourism (Bishunganj O.P) P.S. Case No. 40 of 2016, registered under Sections 341, 323, 307 and 504/34 of the Indian Penal Code. The accusation is that in the morning of 20.10.2016 petitioner along with Santu Yadav and Pintu Yadav were filling earth in the field of informant. When Kamla Devi, wife of the informant, made protest then they started assaulting to her by means of lathi and danda. At that time, Shyam Keshar Yadav, Nagendra Yadav, Sailesh Kumar, Sonu Kumar, Jhulan Yadav and Upendra Yadav also reached there then informant along with his brother also reached there then his family members were assaulted. At that time, Santosh Kumar also caused injury to

Learned counsel for the petitioner submits that while petitioner is named in the F.I.R. along with six others, but no specific overt act has been attributed against the petitioner. Further submission is that the injuries, which are said to the received by the informant and others are simple in nature and petitioner is in custody since 29.12.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Jehanabad in connection with Tourism (Bishunganj O.P) P.S. Case No. 40 of 2016.
