JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 17-02-2018 Heard learned counsel for petitioner and learned counsel representing the State.

Petitioner is seeking anticipatory bail in Khusrupur P.S. Case No. 102/2017, corresponding to G.R. No. 1767/17, for the offences registered under Sections 302/120B of the Indian Penal Code.

Learned counsel for the petitioner submits that the allegation against the petitioner is false. The deceased was interested in learning the driving of the motorcycle and this petitioner had taken him for that purpose but unfortunately met with an accident in which he died.

Learned counsel representing the State submits that the petitioner is named in the F.I.R. and there are sufficient evidence

Patna High Court Cr.Misc. No.6847 of 2018 (2) dt.17-02-2018 2/2 collected in course of investigation by police which would show that this petitioner and other accused persons had assaulted the deceased and killed him.

In the facts and circumstances, considering that the petitioner is named in the F.I.R. and there is an allegation against him of having participated in the alleged occurrence, I am not inclined to grant anticipatory bail to the petitioner. The application is dismissed.
