2. This petition has been filed for modification of order dated 28.11.2018 passed in Cr. Misc. No. 69000 of 2018 by co-ordinate Bench of this court to the extent that provisional anticipatory bail be ordered to be confirmed by learned court below.

3. Earlier vide order dated 10.07.2019 passed in Cr. Misc. No. 42645 of 2019, co-ordinate Bench of this court had directed learned court below to confirm the provisional anticipatory bail granted to the petitioner vide order dated 28.11.2018 passed in Cr. Misc. No. 69000 of 2018 if all the due amount has been cleared off by the petitioner within a period of

4. Learned counsel for the petitioner submits that petitioner and three other accused persons have cleared off the entire due amount and the same has been paid to informant, as evident from the statement of account of informant submitted by the concerned Bank (Annexure-3 to the modification petition).

5. In view of the aforesaid submission, learned court below is directed to confirm the provisional anticipatory bail granted to the petitioner vide order dated 28.11.2018 passed in Cr. Misc. No. 69000 of 2018.

6. Accordingly, modification petition is allowed and order dated 28.11.2018 passed in Cr. Misc. No. 69000 of 2018 is modified to the above extent only.
