The petitioner seeks bail in Nokha P.S. Case No. 210 of 2016, registered for the offences punishable under Sections 8(C), 20(B), 22, 27(A) and 29 of the Narcotic Drugs and Psychotropic Substances Act.
The police intercepted a vehicle and apprehended two persons namely Kundan Kumar and Sanjay Kumar, the petitioner. One Govinda Kumar is said to have fled away.
Learned counsel for the petitioner submits that the petitioner has no manner of concern with the vehicle or the seized Ganja. The petitioner took lift in the vehicle, but he was not knowing the fact that what was kept in the vehicle. The petitioner
Patna High Court Cr.Misc. No.8633 of 2017 (4) dt.19-04-2017 2/2 is in jail since 31.08.2016.
From perusal of the records, it appears that the petitioner and Kundan Kumar, the driver of the vehicle were apprehended and they disclosed that their accomplice Govinda Kumar managed to flee away. They further disclosed that they sold the Ganja to Krishna Gupta @ Kishun and Chandan Singh and the petitioner also disclosed the name of the owner of the vehicle as Amit Kumar Singh.
Considering the facts that the petitioner was traveling in the vehicle along with driver to deliver consignment, I am not inclined to enlarge the petitioner above named on bail. Accordingly, the same is rejected.
