Mr.Arun Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 29-08-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Rajeev Nagar P.S. Case No.477 of 2018 registered under Sections 147, 447 and 387 of the Indian Penal Code. The accusation is that the informant in the year 2018 got Plot No.E-3, Survey Plot No.2713, Tauzi No.5334, Khata No.1553, Thana No.1 of Jai Prakash Nagar Sahakari Grih Nirman Samiti registered in his name by Ashok Kumar Rai, son of Late Ram Naresh Rai, on which the boundary has already been constructed by Ashok Kumar Rai. On 19.11.2018, when the informant went on the aforesaid plot, after three months of getting the agreement to sell of the said plot, to level the land

No.54325 of 2019(2) dt.29-08-2019 2/3 with soil to open the tea-shop, then Chandan Kumar (petitioner) along with 8-10 persons came there and asked the informant that the allotment of the aforesaid plot is with him and if he wants to do the work on the aforesaid plot, then he will have to pay Rs.20,00,000/- to him. When the informant made protest, then Ravi, Pintu, Chhotu, 4-5 ladies and 3-4 unknown male persons, who were with Chandan Kumar (petitioner) and armed with pistols and revolvers, started to try to cause assault to him, due to which the informant became frightened. At that time, the ladies, whose names were Pinki and Kimi, and their associates gave threatening to the informant to implicate him in the case of attempting to outrage their modesty.

Learned counsel for the petitioner submits that, in fact, the plot in question was allotted in the name of the petitioner by the society but with an ulterior motive, the informant has lodged the present case. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount
