JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-03-2017 The petitioners seek bail in Asarganj P.S. Case No. 73 of 2015 registered under Sections 147, 148, 149, 307 of the Indian Penal Code and Section 27 of the Arms Act.
It has been submitted on behalf of the petitioners that no specific allegation of overt act has been attributed to these petitioners rather specific allegation is against co-accused, namely, Pravesh Yadav and Manoj Yadav. It has further been submitted that the petitioners are in custody since 22.11.2016, 20.10.2016 and 18.10.2016 respectively and other co-accused persons having similar allegation have been granted bail vide order dated 09.01.2017 passed in Cr. Misc. No. 54703 of 2016 and vide order dated 16.03.2016 passed in Criminal Miscellaneous
Patna High Court Cr.Misc. No.13941 of 2017 (2) dt.27-03-2017 2/2 No. 11717 of 2016.

Having heard both sides and in view of the fact that no specific overt act has been alleged against the petitioners and similarly situated co-accused have been granted bail, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger in Asarganj P.S. Case No. 73/2015.
