2. The petitioner is apprehending their arrest in a case registered for the offences punishable under Section 30 (a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution, total recovery of 21.40 liter of excise matter is the subject matter of the present case. FIR has been lodged against 3 named accused persons, including the petitioner.

4. Counsel for the petitioner submits that the said recovery has been made from the house of one Ritu Devi and petitioner is the Bhabi of the said Ritu Devi, from whose house the excise material has been recovered. Counsel submits that petitioner is innocent and her antecedent is also clean.

5. Learned APP for the State opposes the prayer for bail.

6. In the present facts and circumstances, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of 6 weeks from today, on furnishing bail bond of Rs. 30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 7th-cumSpecial Judge Excise 2, Madhepura in connection with Madhepura Excise P. S. Case No.516 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

7. Further condition is hereby imposed on the petitioner that if the petitioner is found to be involved in any other similar criminal case then the prosecution shall be at liberty to move for cancellation of his bail bond. (Dr. Anshuman, J.) Ashishsingh/- U T
