Case No.223 of 2013 for the offence under Sections 376 (1)(e), 354 (A), (1)(i)(ii),504, 506, 34 of the I.P.C.

and 3(1) (xi) of the S.C.

& S.T.(POA)Act.

Allegation against the appellant is of committing rape upon the informant along with co-accused.

Submission of the learned counsel for the appellant is that

Patna High Court CR. APP (SJ) No.1113 of 2016 (8) dt.06-11-2017 2/3 other similarly situated co-accused have been granted bail by this Court vide Annexure-2. It has also been submitted that the appellant has falsely been implicated in this case as no case as alleged in the F.I.R. is made out.

Heard learned Special Public prosecutor also.

In view of the prima facie allegation the appeal is not maintainable.

However, the appellant is directed to surrender before the court below and pray for regular bail and the learned court below shall consider on the basis of material available on the record and also consider that other co-accused have already been granted anticipatory bail and dispose of the same.

With the aforesaid observation,
