JUSTICE SANJAY PRIYA ORAL ORDER 19-04-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Hussainganj P.S. Case No. 190 of 2016 instituted for the offence under Sections-302/34 of the Indian Penal Code.
The petitioner is not named in the written report. From the impugned order, it appears that name of this petitioner has been disclosed by one of the co-accused namely Surat Sah from whose house, some looted articles have been recovered. Learned Sessions Judge has referred various paragraphs of C.D. in the impugned order and from perusal of that, it appears that despite the disclosure of name of the petitioner in confessional statement of co-accused, there is no substantial material against the petitioner.
