The petitioners seek bail in Udwant Nagar P.S. Case No. 157/2016, registered for the offences punishable under Sections 20(b) (ii)(c)/22(c) of the N.D.P.S. Act. The informant, S.H.O, Udwant Nagar, got information that ganja is being transported on a vehicle bearing Registration No. CG 04PC 1658. On such, aforesaid vehicle was intercepted, but the occupants of the vehicle started to flee away. Three persons, namely, Santosh Paswan (petitioner no. 1), Raj Kishore Paswan (petitioner no. 2) and Noor Hasan were apprehended. Petitioner Santosh Paswan is said to be driver of the vehicle and petitioner Raj Kishore Paswan had also come on the vehicle from
Patna High Court Cr.Misc. No.11181 of 2017 (2) dt.10-03-2017 2/2 which 85 kg ganja was recovered. Bail of other accused persons, namely, Noor Hasan and Arwal Singh have already been rejected by this Court.
Considering the facts aforesaid and the fact that petitioners were carrying 85kg ganja in a vehicle, I am not inclined to enlarge the petitioners above named on bail. Accordingly, the same is rejected.
