JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 22-08-2017 In the present application under Section 482 of the Code of Criminal Procedure, the petitioner has challenged the order dated 01.08.2016 passed by the Chief Judicial Magistrate, Aurangabad in Madanpur P.S. Case No.42 of 2016 by which cognizance has been taken against him for the offences punishable under Sections 307, 120B and 124A of the Indian Penal Code, Sections 4 and 5 of the Explosive Substances Act, Section 17 of the Criminal Law (Amendment) Act and Sections 38, 39 and 40 of the Unlawful Activities (Prevention) Act.

After some arguments, learned counsel for the petitioner seeks leave to withdraw the present application in order to agitate all the points available to the petitioner in respect of taking

Patna High Court Cr.Misc. No.38400 of 2016 (5) dt.22-08-2017 2/2 cognizance under the provisions of Unlawful Activities (Prevention) Act as well as Explosive Substances Act at the time of framing of charge Leave is granted.
