2. The petitioner is seeking regular bail in connection with Panchanpur P.S. Case No. 53 of 2024 for the offences punishable under Sections 20(b) (ii) (A) of the NDPS Act.

3. As per allegation, on a secret information, the informant along with police personnel reached the place of occurrence. The accused persons tried to flee away after seeing the police party. On search, one kilogram ganja was recovered from the shop of the co-accused Ravi Chaurasia.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that the petitioner was not

Patna High Court CR. MISC. No.59063 of 2024(2) dt.27-08-2024 2/2 arrested at the spot. Nothing was recovered from possession of the petitioner. The alleged recovery of ganja is in small quantity. The petitioner is under custody since 03.06.2024. He has further submitted that the co-accused Ravi Chaurasia from whose shop, the illicit liquor was recovered has already been granted bail by this Court vide order dated 21.08.2024 passed in Cr. Misc. No. 58451 of 2024.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, NDPS Act, Gaya in connection with Panchanpur P.S. Case No. 53 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
