The petitioners apprehend their arrest in Bihariganj P.S. Case No. 133/2016, registered for the offences punishable under Sections 323, 324, 379, 341, 504 and 34 of the Indian Penal Code and section 3/4 of the Prevention of Witchcraft Act. The petitioners are alleged to have assaulted Meena Devi the informant with fists and slaps. When the husband of the informant came, Suresh Das is alleged to have assaulted with Khanti on his head. Pappu Das petitioner no. 1 is alleged to have snatched Rs. 2,000/- from pocket of the husband of the informant. It is submitted that Meena Devi did not receive any
Patna High Court Cr.Misc. No.11947 of 2017 (3) dt.17-04-2017 2/2 injury. Dilip Sah husband of the informant got lacerated wound which are attributed to Suresh Das. There is enmity between both the parties.
Considering the facts aforesaid, the petitioners above-named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate Ist Class, Uda-Kishunganj, Madhepura in connection with Bihariganj P.S. Case No. 133/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
