====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-03-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 302/34 and other ancillary sections of the Indian Penal Code. As per the prosecution case, all the FIR named accused persons including the petitioner and other 6 unknown accused persons brutally assaulted the son of the informant causing his death.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Though there is allegation that the petitioner and coaccused Brajesh Singh shot fire at the victim but the doctor has not found any fire arms injury on the body of the deceased. Present case is counter blast of Bhaganpur Police Station Case
Patna High Court CR. MISC. No.64308 of 2021(3) dt.03-03-2022 2/2 No. 107 of 2019. Similarly situated co-accused has already been allowed bail by a co-ordinate bench of this Court vide paragraph 14 of the bail petition. Petitioner has claimed clean antecedent and he is in custody since 1.7.2021. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate I Vaishali at Hajipur in Bhagwanpur Police Station Case No. 104 of 2019.
