The petitioner apprehends his arrest in connection with Fesar P.S. Case No. 41 of 2022, G.R. No. 683 of 2022 for the offence registered under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code.
As per the prosecution story, the petitioner was selected as a Panchayat Teacher in 2014 but later it came to notice that he has submitted forged BETET marksheet. Accordingly, the FIR was lodged.
Learned counsel for the petitioner submits that he was issued the said BETET result which he had submitted, little realizing that the same is not genuine one and accordingly, did
Patna High Court CR. MISC. No.54824 of 2022(2) dt.18-01-2023 2/2 not resign during the amnesty granted. It is further submitted that now he is out of service as stated in paragraph-11. Learned APP for the State, on the other hand, opposes the prayer for anticipatory bail.
Taking into account the fact that the petitioner do not have criminal antecedent, is now out of service and the FIR has been lodged, he will have to face the music, this Court is inclined to grant him privilege of anticipatory bail. Let the petitioner in the event of arrest or surrender within a period of four weeks from the date of receipt of the order, shall be released on anticipatory bail on furnishing bail of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad in connection with Fesar P.S. Case No. 41 of 2022 subject to condition as laid down under Section 438(2) of the Cr.P.C.
