2. Petitioner seeks regular bail in a case registered for the offences punishable under Sections 341 , 323 , 354, 307, 504, 379 and 34 of the IPC .
3 . As per the prosecution case , informant namely , Nirlesh Kumar alleged that on 08.08.2024 , all the F.I.R. named accused persons including this petitioner forcibly captured the land of informant. When father of informant went to plough the land, then accused persons abused and assaulted him and also refused to vacate the land. It is further alleged that accused persons also demanded Rs. 5 lakh as ransom and took away Rs. 20,000/-.
4. Learned counsel for the petitioner submits that from bare perusla of F.I.R. it is apparent that there is land
Patna High Court CR. MISC. No.53644 of 2025(2) dt.19-09-2025 2/2 dispute between both the parties, for which proceeding under section 144 Cr. P C is going on between the parties. Allegation is general and omnibus against this petitioner. No specific allegation of any overt act is alleged against him. Rest of the allegations are ornamental to make the case grave . Petitioner claims clean antecedent. Petitioner is in custody since 16.06.2025 . Charge-sheet has already been submitted.
5. Learned A.P.P. for the State vehemently opposed the bail application .
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class Khagaria in connection with Chautham P.S. Case No. 250 of 2024 .
