JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-05-2022 At the outset of argument learned counsel for the petitioners seeks permission to withdrawn the anticipatory bail petition of petitioner No.1, Pappu Kumar @ Pappu Yadav and petitioner No.3, Mantu Kumar.

Prayer is allowed.

This anticipatory bail petition is dismissed as withdrawn against petitioner No.1 and 3.

Heard learned counsel for the petitioners and the State.

Petitioners No.2 and 4 apprehend their arrest in a case

Patna High Court CR. MISC. No.64688 of 2021(2) dt.23-05-2022 2/3 registered for the offence punishable under Section 308 and some other ancillary Sections of the Indian Penal Code. As per the prosecution case, all the accused persons, including petitioner No.2 and 4, armed with Lathi came and assaulted both sons of the informant as a result of which they sustained injuries. It is further alleged that petitioner No.3 snatched gold locket from the informant.

Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case. The present case is counter blast of Sherghati PS case No. 292/2021 lodged by the petitioner No.4 against the husband of informant and others. There is general land omnibus allegation of assault and no specific overt act has been attributed against these petitioners. Petitioners have got clean antecedent. Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case and clean antecedent of the petitioners, let the petitioners No.2 and 4, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial
