By the impugned order dated 01.09.2016 passed in Case No. 1113 of 2016, the Sub Divisional Officer, Daudnagar, Aurangabad has converted a proceeding under Section 144 Cr.P.C. into a proceeding under Section 145 Cr.P.C for the reason that there is dispute for possession between the parties and there is apprehension of breach of peace. Since the petitioners have other efficacious remedy, this Court is not inclined to entertain this application.
Patna High Court Cr. WJC No.1262 of 2016 dt.23-11-2017 Accordingly, it stands dismissed.
