The learned counsel for the petitioner had filed Cr.Misc. No. 84071 of 2019 with a prayer to enlarge the petitioner on anticipatory bail. Though the petitioner was not enlarged on anticipatory bail, but vide order dated 18.02.2020, a coordinate Bench of this Court observed as follows:- "Considering the nature of recovery and statement being made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, it is a case for consideration of prayer for regular bail by the

No.64393 of 2021(2) dt.06-07-2022 2/2 learned Court below, if the petitioner surrenders before the learned Court below within a period of six weeks from today in connection with Case No. CI-335 of 2019, pending in the Court of learned Additional Sessions Judge-2-cum-Special Judge, Excise, Katihar."

The learned counsel for the petitioner has submitted that his brother was suffering from Covid-19 and he died due to pandemic, which was the reason for delay of his surrender within the stipulated time.

Considering the above facts and circumstances, the petitioner is directed to surrender before the court below within four weeks from today and make a prayer for regular bail. With these observations, the petition is disposed of. Office shall ensure that all the defects are removed by the petitioner within the stipulated time provided in para 1 hereinabove, failing which the matter shall be brought to the notice of this Court.
