2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341 , 323 , 385, 327, 427, 504, 5069/34 of the Indian Penal Code.
3. It is alleged that these petitioners along with other co-accused persons have restrained the informant from going on his own land and they have also threatened to kill him.
4. It is submitted on behalf of the petitioners that both parties are neighbours and due to long standing land dispute, this false and concocted case has been lodged against this
Patna High Court CR. MISC. No.55145 of 2023(2) dt.23-08-2023 2/2 petitioners only to harass and humiliate them. Rest of the allegation is super-addition to make the case grave .
5. Learned counsel for the State oppose the bail petition.
6 Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate , Motihari, East Champaran in connection with Pipra Kothi P.S. Case No. 67 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
