JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-11-2019 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Bihar P. S. Case No. 389 of 2019, registered for the offences punishable under Sections 419, 420, 467, 468 and 472/34 of the Indian Penal Code.

One F.I.R. named accused Makeshwar Nath, Son of Kavindra Singh, Village- Mohabbatpur, P. S. Shekhopur, District- Sheikhpura was arrested when he replaced the A.T.M. Card of the informant and the aforesaid apprehended accused disclosed the name of the petitioners. However, learned counsel for the petitioners submit that they have inimical terms with the

Patna High Court CR. MISC. No.53129 of 2019(3) dt.16-11-2019 2/2 apprehended accused Makeshwar Nath and that is why, apprehended accused Makeshwar Nath implicated the petitioners in the present case.

Learned counsel for the petitioners drew my attention towards Annexure-2 to the petition and submitted that prior to the alleged occurrence, the full brother of co-accused Makeshwar Nath had lodged Shekhopur Sarai P.S. Case No. 56 of 2017 for the offence punishable under Section 307 and other minor sections of Indian Penal Code against the petitioners. Considering the facts and circumstances of the case as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, above named, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Bihar Sharif in connection with Bihar P.S.
