The petitioner seeks bail in a case registered under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.

On tip off about congregation of several accused persons in the hut for committing some offence, informant along with police posse raided the hut and apprehended the petitioner and co-accused Sandeep Kumar while other accused persons managed to escape. He recovered one loaded country made pistol and one empty cartridge from the possession of the petitioner.

It is submitted by learned counsel for the

Patna High Court CR. MISC. No.52995 of 2019(3) dt.27-11-2019 2/2 petitioner that the petitioner has no concern with the aforesaid occurrence. No incriminating article has been recovered from the conscious physical possession of the petitioner. He has been falsely implicated in the case at the instance of his enemy by planting aforesaid recovery from his possession. Though the petitioner is having several criminal antecedents, but he has been remanded in the aforesaid cases after the occurrence under hand. He has been languishing in custody since 18.11.2017. Having regard to the facts and circumstances of the case and considering the period of custody, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Silao P.S. Case No. 226 of 2017.
