JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 27-03-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

It is alleged by the informant that her husband has been murdered by her in-laws family members including the petitioner.

Patna High Court CR. MISC. No.58012 of 2022(4) dt.27-03-2023 2/3 been implicated in this case. The petitioner is mother of the deceased and there is general and omnibus allegation against her. During course of investigation, it came to light that on trivial issue, some altercation took place between the family members and the deceased started assaulting his own father by thrashing him down and in that course, the deceased was assaulted by coaccused Sonu Das on his head by some hard and blunt substance since the deceased was attempting to kill his father by pressing his neck. There is no direct allegation against the petitioner. The petitioner is languishing in custody since 11.05.2022.

Learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount
