The petitioner seeks bail in Chainpur P.S. Case No. 139 of 2015 registered under Sections 420, 409 and 34 of the Indian Penal Code.

The petitioner is alleged to have taken advance of Rs. 6,64,776/- for execution of work in the year 2007-08, but he did not complete the work. The petitioner also did not complete the work of construction of boundary wall for which he has taken advance of Rs. 1,34,000/-.

Leanred counsel for the petitioner submits that he has already completed the work for which he has taken advance of Rs. 6,64,776/-. He did not complete the work of construction

Patna High Court Cr.Misc. No.14101 of 2017 (2) dt.12-04-2017 2/2 of boundary wall. The petitioner undertakes to complete the construction of boundary wall within three months from the date of release. It is submitted that the materials for construction work have already been kept at the construction site. Considering the facts aforesaid, undertaking of the petitioner and the petitioner is in jail since 01.12.2016, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Kaimur at Bhabua in connection with Chainpur P.S. Case No. 139 of 2015.
