JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 16-05-2018 The present application has been filed for modification of the order dated 21.12.2017 passed in Cr. Misc. No. 61723 of 2017 to the extent of modifying the condition for producing the challan for accepting bail bonds. The petitioner being the driver of the truck was apprehended with a truck loaded with stone chips. The petitioner claimed that the stone chips were being transported on the basis of valid challan and hence, the petitioner was granted anticipatory bail, but now it is submitted that the petitioner has lost the valid challan when the vehicle was intercepted.

This Court is not inclined to modify that condition because on the statement made in the main petition that the stone chips were being transported on the basis of valid

Patna High Court Cr.Misc. No.29736 of 2018 (2) dt.16-05-2018 challan. The petitioner was granted anticipatory bail. Hence, the order dated 21.12.2017 passed in Cr. Misc. No. 61723 of 2017 with regard to the petitioner Guddu Kumar Paswan is, hereby, rescinded.

However, let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned Court below within a period of six weeks from today in connection with Baroon P.S. Case No. 25 of 2017, pending in the Court of learned Chief Judicial Magistrate, Aurangabad.

Accordingly, this modification application is disposed of.
