====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-12-2025 Heard learned counsel for the petitioner and the State.

2. Petitioner seeks regular bail in a case registered for the offences punishable under Section 304/34 of the Indian Penal Code.

3. Petitioner and other accused persons are alleged to have operated brother of informant without having valid qualification, degree and experience as a result of which he died.

4. Learned counsel appearing for the petitioner submits that post mortem report reflects that brother of informant died due to septicemia and CR failure as a result of ruptured appendices. Charge sheet has already been submitted in the case. Petitioners claim clean antecedent and he is in custody since 6.1.2025.

5. Learned A.P.P. appearing on behalf of the State

Patna High Court CR. MISC. No.61243 of 2025(2) dt.04-12-2025 2/2 vehemently opposed the prayer for bail.

6. In view of the facts of the case and period of custody of the petitioner, let the petitioner named above be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the District and Additional Sessions Judge 14, Sitamarhi in Bela Police Station Case No. 49/2024, Sessions Trial No. 211/2025.
