The petitioner, already in custody, seeks bail in connection with Gardanibagh P.S. Case No. 5 of 2017 registered under Sections 417/420/34 of the Indian Penal Code. Allegation in brief is that the petitioner in place of some other persons, took examination and also the L.T.I. of the petitioner while sitting in the written examination and L.T.I. taken in the Bio-metric machine at the time of physical test, does not tally.
The counsel for the petitioner submits that only allegation is that both the L.T.I. do not tally completely and this petitioner has been in custody since 11th January 2017 and a
Patna High Court Cr.Misc. No.9309 of 2017 (3) dt.15-03-2017 2/2 co-ordinate Bench of this Court has already granted bail to the similar situated accused in Criminal Misc. No. 8294 of 2017. Having considered the aforesaid facts and circumstances, the petitioner, namely, Raju Kumar, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Smt. Sangeeta Rani, Sub-Judge-XIV-cum-Additional Chief Judicial Magistrate, Patna in connection with Gardanibagh P.S. Case No. 5 of 2017.
