Patna High Court Cr.Misc. No.46435 of 2013 dt.14-07-2016 2/2 Heard learned counsel for the Petitioners and the State. The Petitioners seek quashing of the order of cognizance dated 24.4.2013 passed by the Chief Judicial Magistrate, Sitamarhi, in G.R. No. 1866 of 2012, Trial No. 3472 of 2013 arising out of Sitamarhi Mahila P.S. Case No. 03 of 2012.
A supplementary affidavit has been filed stating therein that all matters have been compromised.
In view of such, further Proceedings including the order of cognizance dated 24.4.2013 passed by the Chief Judicial Magistrate, Sitamarhi, in G.R. No. 1866 of 2012, Trial No. 3472 of 2013 arising out of Sitamarhi Mahila P.S. Case No. 03 of 2012 and Misc. Case No. 111 of 2012 pending before the Principal Judge-cum-Family Court, Sitamarhi. The Parties are directed to file a joint petition under Section 13B of Hindu Marriage Act in Matrimonial Case No. 40 of 2012 before the Principal Judge, Family Court, Sitamarhi, within a period of four weeks from today, upon which the Family Court, Sitamarhi, shall pass necessary orders considering that the spouses have deposed before this Court that they do not wish to continue the matrimonial relationship. With the aforesaid observation, the application stands disposed off.
