JUSTICE ANIL KUMAR SINHA ORAL ORDER 16-08-2019 The petitioners apprehend their arrest in connection with Sigori P. S. Case No. 18 of 2019 registered under Sections 323, 341, 354, 354(a), 504 and 506 of the Indian Penal Code. Allegation against the petitioners, as per FIR, is that when daughter of the informant was coming from coaching, she was stopped by one Uday Yadav who caught her hand and tried to outrage her modesty. It has further been alleged that when informant went to the house of the accused persons, the petitioners abused the informant and assaulted her by bricks etc. Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent inasmuch as petitioner no. 1 is father and petitioner no. 2 is brother of Uday Yadav who allegedly tried to outrage the modesty of the daughter of the

Patna High Court CR. MISC. No.50763 of 2019(2) dt.16-08-2019 2/2 informant. Learned counsel further submits that only allegation against the petitioner is that when informant came to their house for making complain against Uday Yadav, she was abused and assaulted by the petitioners.

After having heard learned counsel for the parties and taking into consideration the fact that there is no specific allegation against the petitioner of outraging the modesty of the daughter of the informant, as such I am inclined to grant anticipatory bail to the petitioners.

Let the petitioners, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge I-cum-POCSO Court, Patna in connection with Sigori P.S.Case No. 18 of 2019; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
