The petitioner seeks bail in connection with Sessions Trial No.145 of 2015, arising out of Madhepur P.S. Case No.185 of 2014, registered under Sections 414 and 400/34 of the Indian Penal Code besides Sections 25(1-B)A, 26 and 35 of the Arms Act.

The accusation is that on receiving secret information about gathering of the miscreants in village-Bhith Bhagwanpur for the purpose of committing dacoity, the police party reached there, then some persons were seen fleeing away from the orchard of Shambhu Singh. Patna High Court Cr.Misc. No.7021 of 2017 (2) dt.09-03-2017 2/2 disclosed their name as Purusotam Kamat (petitioner) and Bhavesh Kumar Yadav. On query being made by the police, the petitioner disclosed the name of four persons, who succeeded to flee away. On search, one country made pipe gun (Katta), one live cartridge, one empty cartridge, one motorcycle and two empty bottles of Indian Made Foreign Liquor were recovered from the orchard of Shambhu Singh.

Learned counsel appearing on behalf of the petitioner submits that the petitioner has falsely been implicated in this case on mere suspicion. The petitioner is in custody since 26.11.2014. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-V, Madhubani, in connection with Sessions Trial No.145 of 2015, arising out of Madhepur P.S. Case No.185 of 2014.
